General Terms and Conditions for Cashoyo Users

These Terms and Conditions ("Terms") explain the overall view of personal information we collect, with whom we share the information gathered, and how Cashoyo services utilize, share, and store information from and to other parties. Please read these Terms in their entirety so that you may know all parts and understand the content. By downloading, installing, accessing, or using the Cashoyo mobile application (the "Cashoyo App") and any of the products or services made available therein (collectively, the "Services"), you agree to be bound by these Terms.
The Cashoyo App is owned and operated by Philippine Cashtrout Lending Corporation (the "Company", "we", "us", or "our"), a corporation duly organized and existing under the laws of the Republic of the Philippines, with SEC Registration No. CS201910407, and licensed by the Securities and Exchange Commission to operate as a financing/lending company under Certificate of Authority No. CA3015. Although the Cashoyo App is operated by the same Company that operates the Mocasa platform, it is published under a separate developer account and constitutes a distinct mobile application with its own user base and Services.
Eligibility
This Cashoyo App and the Services are solely for the use of the following:
- User applicant of at least eighteen (18) years of age, with capacity to enter into a loan or credit programme, with present employment or other source of income, and in good credit standing. With this, he/she may avail of the products and services offered through the Cashoyo App.
- By creating a personal account, you represent yourself and ensure that you possess all of the foregoing eligibility requirements, (a) in the case of a Lender or Borrower, and (b) in the case of a Lender. You likewise expressly authorize Cashoyo to use all necessary means to verify your identity, including sharing information, personal and non-personal, you have provided with any third-party service provider and/or data processor.
Terms and Conditions
1. Personal Information Disclosure
a. By applying for an account, you are agreeing with the content of these Terms and Conditions and giving your consent for us to collect, use, disclose, retain, and protect your personal information, in accordance with the Data Privacy Act of 2012 (Republic Act No. 10173), its Implementing Rules and Regulations, and the issuances of the National Privacy Commission, as well as our Privacy Policy made available at https://www.cash-oyo.com/privacy.
2. Borrower's Representations, Warranties & Undertakings
The Borrower hereby represents and warrants to the Lender on a continuing basis that:
a. The information provided by the Borrower in his/her loan application and in the Loan Agreement are true, complete, correct, and accurate as of the date it was given. For this purpose, the Borrower hereby authorizes the Lender to collect, use, process, disclose, exchange, and store his/her personal information to facilitate the transaction contemplated in the Loan Agreement. For the personal information of other individuals provided by the Borrower, including character references and, where applicable, guarantors or co-makers, the Borrower represents and warrants that he/she has informed such individuals and is authorized to disclose their personal information. Character references shall be used solely for identification, screening, investigation, and verification purposes and shall not be treated as guarantors or co-makers or contacted for collection of the loan obligation unless they have separately and expressly consented to act as guarantors or co-makers. Guarantors or co-makers may be contacted in relation to loan obligations only to the extent allowed by applicable law and their separate consent.
b. Cashoyo may temporarily stop or restrict your account if we detect any suspected fraudulent activity. Usage of Cashoyo Services means that you will comply with this Agreement continuously and until, and unless, there is a User’s request for closure of account.
c. User wholeheartedly agrees and authorizes Cashoyo to provide user information to third-party digital service providers for this application. User undertakes that his/her identity information provided is true, complete, and accurate, and undertakes to accept the corresponding legal consequences therefrom.
d. The Borrower expressly authorizes Cashoyo to perform identity verification by means of, and to process biometric data (including but not limited to facial images and liveness data) and device information for, anti-fraud, "Know-Your-Customer" (KYC), and security purposes. The Borrower further authorizes Cashoyo to verify the order submission through one-time password (OTP) sent via SMS or voice call and/or face recognition, in line with industry-standard authentication practices.
3. Loan Terms and Conditions
a. Cashoyo is a multi-use application to be used for legal purposes only.
b. The loan amount approved is based on the assessed Borrower's capacity to pay during credit verification.
c. The loan amount approved may be disbursed as cash to the Borrower’s designated disbursement account or used as credits within the Cashoyo platform, depending on the specific loan product availed.
d. The Company will compute for the penalty, if there is a delinquency, and it will form part of the outstanding balance of the Borrower.
e. Interest, if any, shall be computed based on the prevailing interest rate, equivalent Annual Percentage Rate (APR), where applicable, and other charges disclosed in the applicable Disclosure Statement provided to the Borrower prior to the consummation of the loan, in accordance with the Truth in Lending Act (Republic Act No. 3765), SEC Memorandum Circular No. 14, Series of 2025, and any subsequent amendments or superseding issuances, to the extent applicable.
f. Payment Default. In cases of default on payment, the Company will compute the penalty and it will form part of the outstanding obligation of the Borrower. The Company may also contact the Borrower's guarantor or co-maker, if any, in relation to the loan obligation, and may contact a character or credit reference solely for identity, contact-details, or verification purposes and not for debt collection or disclosure of the Borrower’s delinquency, except to the extent expressly permitted by law and by that person’s separate consent. The Company may report the delinquency to the Credit Information Corporation (CIC) and/or other accredited credit bureaus pursuant to the Credit Information System Act (Republic Act No. 9510).
g. Credit approved balance depends on the Borrower's capacity to pay, which is based on the verification process. The Company has the right to decline a loan application when a basis of wrong information is detected.
OGives Cash Loan Specific Terms
In addition to the foregoing Loan Terms and Conditions, the following provisions specifically apply to the OGives cash loan product (the "OGives Loan") offered through the Cashoyo App. In case of inconsistency between these provisions and the general Loan Terms and Conditions, these provisions shall prevail with respect to the OGives Loan.
a. Loan Parameters. The OGives Loan is a small-amount, short-tenor cash loan. The principal amount, tenor, and other key parameters of each OGives Loan shall be selected by the Borrower from among the options made available within the Cashoyo App at the time of application. Such parameters may be updated by the Company from time to time, and the parameters displayed within the Cashoyo App, together with those set out in the Disclosure Statement provided to the Borrower prior to the consummation of the loan, shall prevail.
b. Interest and Service Fee. Prior to the due date, the OGives Loan is offered at zero percent (0%) nominal interest rate and zero (0) service fee charged by the Company. The applicable interest rate, fees, and total cost of credit shall be set out in the Disclosure Statement provided to the Borrower prior to the consummation of the loan, and at all times shall comply with SEC Memorandum Circular No. 14, Series of 2025, and any subsequent amendments or superseding issuances, to the extent applicable.
c. Convenience Fees. The Borrower acknowledges and agrees that, separate and distinct from any interest and service fees charged by the Company, third-party payment service providers (such as banks, e-wallets, payment aggregators, and over-the-counter payment partners) may charge convenience fees, transaction fees, or similar charges for the disbursement of the loan proceeds and/or for the repayment thereof. Such convenience fees are levied by, and payable to, the relevant third-party payment service provider, and are not waived by the Company.
d. Loan Application Windows. Applications for the OGives Loan may only be submitted during the daily application windows made available within the Cashoyo App. The Company reserves the right to adjust the schedule, frequency, and capacity of such application windows from time to time, including by closing applications when the available principal pool for a given window has been fully allocated.
e. Mandatory Credit Reporting Consent. By submitting an OGives Loan application, the Borrower expressly consents to the reporting of the Borrower’s loan-related credit information (including, without limitation, the existence of the loan, repayment history, and any delinquency or default) to the Credit Information Corporation (CIC) and/or other accredited credit bureaus, in accordance with the Credit Information System Act (Republic Act No. 9510) and the regulations promulgated thereunder. Such consent is required prior to the submission of the loan application. Any withdrawal of consent shall not affect credit reporting or other processing that is required or permitted by law, or that remains necessary for the performance of the OGives Loan, the establishment, exercise, or defense of legal claims, regulatory compliance, or obligations that remain outstanding.
f. Overdue Penalty. In the event the OGives Loan is not paid in full on or before the due date, a penalty fee shall accrue at the rate, frequency, and aggregate cap as displayed within the Cashoyo App and as set out in the Disclosure Statement provided to the Borrower prior to the consummation of the loan. Such rate, frequency, and aggregate cap may be updated by the Company from time to time, subject at all times to compliance with SEC Memorandum Circular No. 14, Series of 2025, and any subsequent amendments or superseding issuances, to the extent applicable. The values displayed within the Cashoyo App and the Disclosure Statement at the time of application shall prevail.
g. Permanent Disqualification. The Borrower acknowledges and agrees that any delinquency on the OGives Loan, whether subsequently cured by full settlement or not, will result in the Borrower’s permanent disqualification from availing of any further OGives Loan. For the avoidance of doubt, settlement of an overdue OGives Loan shall not restore the Borrower’s eligibility to avail of the OGives Loan in the future, although the Borrower may continue to access other Services made available within the Cashoyo App in accordance with these Terms.
h. Charge-Off. Charge-Off shall not extinguish the underlying obligation of the Borrower, and the Company reserves the right to continue lawful collection efforts and to maintain records relating to the disqualification only for as long as necessary for the declared, specified, and legitimate purposes of credit risk management, legal claims, regulatory compliance, and enforcement of the disqualification policy, and in all cases subject to secure disposal in accordance with applicable law.
i. Loan Application Review. Each OGives Loan application shall be subject to a two-tier review process consisting of (i) automated risk and anti-fraud screening, and (ii) where applicable, manual review by Company personnel. The Borrower may, where prompted, voluntarily contact the Company’s designated review channels (such as WhatsApp or Viber) for the purpose of facilitating manual review. The Company endeavours to complete its review within one (1) business day of submission, but does not guarantee any specific turnaround time. The Company reserves the right to approve or decline any application in its sole and absolute discretion.
j. Loan Extensions (where made available). Where, and to the extent that, the Company makes available a free loan extension feature within the Cashoyo App, the Borrower may apply, prior to the due date and subject to eligibility, for a free extension of the OGives Loan for an additional period as set forth in the Cashoyo App at the time of the extension request, with no penalty accrued for the extension period. The number, eligibility criteria, and operating mechanics of such extensions shall be as set forth in the Cashoyo App from time to time. The availability of any such extension feature is at the sole discretion of the Company.
Registration and Application
In creating an account or applying to become a Cashoyo user/lender, you agree to provide accurate, true, and complete information about your personal identity during registration and application. In this, we are secured that the necessary documents are legitimate for such reason. If during verification of data we see untrue, not current, inaccurate, or incomplete information, we will reject the application and will restrict your access in the application in the future, that will cause you locked of capacity to avail products and services. The Company will also deny your access to the site/decline any loan application on our end. Before you register and use this application, it is important for you to know that the Services we offer can only be provided if you agree to provide and disclose accurate, true, and complete information on your behalf and agreed with your instruction and authorization.
a. User must be an individual who is a certified citizen of, and residing in, the Philippines.
b. Of legal age, at least eighteen (18) years of age.
c. Have accurate information declared for documentations. User will submit accurate, true, and correct information and will comply with applicable laws and regulations.
d. Where you have separately opted in or otherwise provided valid consent, you may receive marketing content from Cashoyo via email, text messages, calls, push messages, or other communication notifications. You may withdraw such marketing consent at any time by contacting our customer service channels indicated below or by adjusting the available preferences within the Cashoyo App, without prejudice to communications strictly necessary for the operation of the Services.
e. When applying for an OGives Loan, the User shall be required to select, from a single-select mandatory list, the intended purpose of the loan from among the options made available within the Cashoyo App from time to time. Such information shall be used for risk control, regulatory compliance, and analytical purposes.
Third-Party Loan Products and Referral Services
a. The Cashoyo App may, from time to time, display, recommend, or otherwise make available within the Cashoyo App information regarding lending or financial products offered by duly licensed third-party providers ("Third-Party Loan Products"). Such Third-Party Loan Products may be presented through application programming interface (API) integrations and/or as a directory or listing of products.
b. The Borrower acknowledges and agrees that any Third-Party Loan Product is offered solely by the relevant third-party provider, and that the contractual relationship arising from any application for, or availment of, a Third-Party Loan Product shall be exclusively between the Borrower and the relevant third-party provider. The Company is not a party to such contractual relationship and makes no representation or warranty regarding the suitability, terms, or performance of any Third-Party Loan Product.
c. Where the Borrower wishes the Company to share his/her personal information with a third-party provider for the purpose of facilitating the Borrower’s availment of a Third-Party Loan Product, the Borrower must give a separate, specific, and informed authorization for such sharing. By default, no such sharing shall occur unless and until such authorization is granted by the Borrower in the manner provided within the Cashoyo App. The Borrower may withdraw such authorization at any time, without prejudice to processing already validly performed prior to the withdrawal.
d. The Company may receive referral fees, commissions, or other forms of compensation from third-party providers in connection with the Borrower’s availment of a Third-Party Loan Product. The Borrower acknowledges this commercial arrangement and agrees that it does not, by itself, give rise to any liability of the Company in respect of any Third-Party Loan Product.
Advertising and Promotional Content
a. The Cashoyo App may display advertisements and promotional content, including, without limitation, banner advertisements, interstitial advertisements, rewarded interstitial advertisements, and native advertisements, served through third-party advertising networks (such as Google AdMob and similar advertising platforms). Such advertisements may be displayed within various sections of the Cashoyo App, including the home screen, content sections, and result pages.
b. Third-party advertising networks may collect and process certain device and usage information (including, where applicable, advertising identifiers) for the purposes of serving, measuring, and improving advertisements. Where required by applicable law or platform policy, such collection, processing, or sharing shall be subject to the User’s consent or other lawful basis before it is carried out. Such collection and processing are governed by the privacy policies of the relevant third-party advertising networks. The Borrower may exercise platform-level controls (such as opting out of personalized advertising or resetting the advertising identifier) where the operating system or device makes such controls available.
c. The Cashoyo App may also include editorial, educational, or informational content (including a content or "Blog" section) intended to assist Users in making informed financial decisions. Such content is provided for general informational purposes only and does not constitute financial, legal, tax, or investment advice.
Convenience Fee
- When using Cashoyo Services, the User agrees and consents to being charged the related convenience fees. These convenience fees are payments to the merchants, payment aggregators, and payment processors (such as MPAY Philippines, Inc.) that facilitate the User’s transaction, and are not charged by, or for the benefit of, the Company. For the avoidance of doubt, the Company does not charge any service fee in respect of the OGives Loan.
b. When using Cashoyo Services (such as cash loan disbursement or repayment), the User agrees to pay through third-party entities (such as banks, e-wallets, or third-party payment companies, etc.) and to bear any convenience fees that may be charged by such third-party entities.
c. Without limiting the generality of the foregoing, third-party payment service providers may charge convenience fees or similar charges for both the disbursement of loan proceeds and the receipt of repayments. Such convenience fees are levied by the relevant third-party payment service provider, are not waived by the Company, and shall be borne by the User in addition to any penalties payable to the Company.
Credit Application Verification
a. You agree that all details submitted for application are all correct and current.
b. By giving details of your reference person/s, you confirm that you have informed them and are authorized to provide their personal information to Cashoyo for screening, investigation, and verification purposes. Character references are not guarantors or co-makers and will not be contacted for collection of the loan obligation unless they have separately and expressly consented to act as guarantors or co-makers.
Liability for Misuse of Account
Cashoyo will not be liable for any loss that you've done, i.e.; misuse of account as a result of allowing somebody to use your personal account.
Account Security
Cashoyo has implemented high value of adequate security as required by the Data Privacy Act of 2012 (Republic Act No. 10173); however, Cashoyo will not give any guarantee or warranty with respect to the same. In line with this, you hereby acknowledge that all provided information is at your own risk. Nothing in this section shall limit the Company’s obligations or liability that cannot be excluded under the Data Privacy Act of 2012, the Financial Products and Services Consumer Protection Act (Republic Act No. 11765), or other applicable law.
Privacy
You agree that the following personal information you used are your personal information, such as:
- Full name, birthdate, gender, permanent and residential address, registered number, birthday, birthplace, identification card together with live self-scan procedure;
- Other personal information which will be requested during the 2nd level of application process;
- Information from third parties including information obtained, upon your authorization, from your employers ("Employment Information") and transaction, financial, and credit history stored by third parties ("Transaction and Credit Information"); and
- Traffic and usage information generated from your visits to the Site or use of the Cashoyo App.
The processing of the foregoing personal information shall be governed by the Cashoyo Privacy Policy, available at https://www.cash-oyo.com/privacy, which forms an integral part of these Terms.
Customer Care Assistance
a. Cashoyo values customers by providing a reliable customer service platform that is able to understand the user situation and receive complaints about their experience with the application for continuous development of the application, products, and services.
b. For immediate concerns, you can use the following channels for raising concerns:

You understand that for urgent concerns you shall contact our In-App Live Chat Support for immediate assistance, instead of using electronic mail because it will take time to respond about your concern.
c. You understand that Cashoyo shall provide you updates on your request on regular process within the prescribed processing time, in which you will be informed of.
Force Majeure
Cashoyo is not committed with any responsibility to the User for some delay or failure to perform due to any unexpected reasons beyond company control, including the following but not limited to: natural disasters (typhoons, earthquakes, tsunamis, floods), public strikes or riots, demonstrations, acts of military and public war, failure of telecommunications or other facilities, or casualties.
Amendments and Modifications
Cashoyo may, from time to time, amend or modify these Terms in order to (i) reflect changes in the Services made available through the Cashoyo App, (ii) comply with applicable laws, regulations, and orders of competent regulatory authorities, or (iii) reflect changes in operational, security, or commercial practices. Notice of any material amendment shall be given by reasonable means, including, without limitation, by in-app notice, push notification, or by posting an updated version of these Terms within the Cashoyo App. The continued use of the Services following the effectivity of any such amendment shall be deemed an acceptance of the amended Terms. If the User does not agree to the amended Terms, the User’s sole remedy is to discontinue use of the Services and request closure of his/her account, without prejudice to obligations that have accrued prior to such closure.
Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict-of-laws provisions. Any dispute, controversy, or claim arising out of or relating to these Terms, the Services, or the relationship between the User and the Company shall first be addressed by good-faith discussion through the customer care channels indicated above. Failing amicable resolution, any such dispute shall be brought before the proper courts of Makati City, Metro Manila, Philippines, to the exclusion of all other venues, without prejudice to (i) the User’s right to lodge a complaint with the relevant regulatory authority (including the Securities and Exchange Commission, the National Privacy Commission, or the Bangko Sentral ng Pilipinas, as the case may be) under applicable consumer protection laws, including the Financial Products and Services Consumer Protection Act (Republic Act No. 11765), and (ii) any rights of the User that cannot be waived under applicable law.
Effectivity
This Agreement shall become effective as of the date of approval after successful registration. The version of these Terms in effect at the time of any given access or use of the Services shall govern such access or use.
By tapping "Agree", "Continue", "Submit", or by otherwise accessing or using the Cashoyo App or the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.
